All real estate is subject to taxation, except when specifically exempted by the Virginia Constitution. Property is assessed as of January 1. Tax bills are due June 5 and December 5. The Code of Virginia Section 58.1-3252 authorizes a county with a population of 50,000 or less to elect by a majority vote of its Board of Supervisors to conduct a general reassessment of real estate at either five or six-year intervals. Between reassessments, the Commissioner is responsible for assessing any new construction or additions. Real Estate Tax Relief for the Elderly & Handicapped

 

If you are 65 years years old or older on January 1 of the tax year or 100% disabled, earn less than $50,000 in income from all sources, and have less than $150,000 in net worth, you may be entitled to an exemption on your Real Estate Tax or Mobile Home Tax.  Applications for relief from Real Estate Tax or Mobile Home Tax must be filed annually between January 15 and March 31.  Applications are available and must be filed with the Commissioner of the Revenue.  For an application or if you have any questions, please call (434) 946-9310.

 Land Use Program for Tax Relief
A land use assessment ordinance is in effect to encourage the continuance of agricultural, horticultural, forest, and open space land uses in the county. This is a special program under which applicants with eligible land will have their land valued for tax purposes according to its use value rather than its fair market value. The minimum parcel size for agriculture or horticulture use is 5 acres, and land must be devoted to actual production. The minimum parcel size for forest use is 20 acres. The owner has to complete and sign an agreement to maintain and protect forest land by following a planned program of timber management and soil conservation practices. The open space land includes only land which has been dedicated for public use, such as parks, golf courses, and game preserves. Idle, vacant land does not qualify under any category. Sign-up is from Sept. 1st through Nov. 1st in the Commissioner's Office. Applicants must pay a minimum filing fee of $10 for 100 acres or less and .10 cents per acre over 100 acres that qualify. Taxes must not be delinquent to qualify. When land qualified for assessment and taxation according to use has been converted to a non-qualifying use or rezoned to a more intensive use at the request of the owner or his agent, that land is subject to the roll-back tax. In the event of a change in use, acreage, or zoning, the property owner MUST report the change to the Commissioner's Office within 60 days of said change.

The County's financial condition is reported in the County's Comprehensive Annual Financial Report (CAFR), which is prepared by an outside auditing firm. Their findings are published annually and must be submitted to the Auditor of Public Accounts for the State of Virginia. This document provides a complete overview of all revenues and expenditures of the County.

Not all work requires a building permit. Some projects not requiring a permit are:
  • Drywall repair and painting
  • Residential reroofing
  • Residential exterior siding
  • Tents that cover 900 square feet or less and have an occupant load of less than 50 persons
  • Fences
  • Floor coverings and porch/deck flooring; and/or
  • One-story detached residential accessory structures under 256 square feet (including detached prefabricated structures under 256 square feet).*
  • Swimming pools with less than 150 square feet of surface water, and less than 5000 gallons capacity, and less than 24 inches of water depth*

The Solid Waste Division (SWD) operates the only municipal landfill in Amherst County.  The landfill is open to residents of Amherst County, as well as, commercial customers for disposal of garbage.  The landfill only accepts municipal solid waste and non-hazardous industrial waste generated in Amherst County.

The County Landfill is located at 715 Kentmoor Farm Road. 

The Landfill is open Monday-Friday from 8:00 am - 4:00 pm

and Saturdays from 8:00 am -12:00 pm.

All Public Works Locations are closed New Years Day, Independence Day, Thanksgiving Day, and Christmas Day.

The 275-acre landfill (of which 38 acres is current permit disposal area) is located on State Route 613 (Kentmoor Farm Road), approximately seven miles northeast of Madison Heights.  Owned by Amherst County and operated by the SWD, the landfill receives over 30,000 tons of solid waste a year.  Contact the landfill if you or your group or organization wishes to arrange for a tour (434) 846 - 3324.

 

The Amherst County 9-1-1 Communications Center serves as the public safety answering point (PSAP). The center takes calls for and dispatches the Amherst County Sheriff's Office, Amherst Town Police, Amherst Fire Department, Amherst Life Saving Crew, Monelison Fire and Rescue Department, Pedlar Fire, Amherst County Animal Control. The center answers and makes over 140,000 phone calls per year and dispatches over 39,000 calls of service. Even though the Amherst County 911 Center has multiple functions, there are two primary job functions within the Communications Center.

1. Receiving Incoming Calls. When a telephone call is received by the Center either via 911 or on a non-emergency line, the telecommunicater collects the information from the caller.

2. Dispatching The Call. The operator then dispatches the call to the appropriate agency or agencies.

The center is composed of four consoles that contain three computers each in addition to the 911 phone system. Each console has a computer for computer aided dispatch (CAD), mapping and our 800mhz radio system. Our Computer Aided Dispatch system is provided by IDNetworks and our 911 mapping is provided by MSAG. Amherst County is part of the regional radio system along with the City of Lynchburg and Bedford County.

The Amherst County Animal Care Center has dogs, cats, and occasionally other animals available for adoption. Adoptions are made available through the Adoption Center, which is operated by the Amherst County Humane Society. Adoption viewing will be public at scheduled times. If you arrive before the designated viewing hours, you may wait until the scheduled hours or return at the appropriate times.
 
Virginia law requires that all dogs and cats adopted from the Adoption Center be spayed or neutered as part of the adoption process. The adoption fee includes the spaying and neutering surgery fee.
 
The Animal Care Center staff will be available to provide information about the animals and to answer questions. Adopting an animal represents a commitment to care for the animal for many years. Adopters are encouraged to spend as much time with the chosen animal to ensure it matches their home and lifestyle best.
 
Remember that even though we take the best possible care of animals at our Care Center, we do not always know their prior medical history or vaccination status. We perform basic health checkups but do not have veterinarians on staff.

Animal Control Officers fall under the Sheriff's Office and enforce Virginia State laws, Amherst County, and Amherst Town ordinances that pertain to animals. In addition, Animal Control Officers are responsible for providing emergency services to the entire county and its towns 24 hours a day, seven days a week.
 
Reporting an Incident: To report an animal incident, such as an animal bite, a dog running loose, an animal in distress, or a possible case of animal cruelty or neglect, please call Amherst County Dispatch at 434-946-9300.
 
Emergency Response Hours: Outside of regular business hours, an Animal Care and Control Officer is designated "On-Call" and will only respond to health and safety-related emergencies. Citizens may request assistance from the Animal Care and Control Officers by calling the Amherst County Dispatcher at 434-946-9300.

  1. Enforcement of state, county, and town laws dealing with domestic animals.
  2. Investigation of aminal attacks on humans, domestic animals, dangerous and vicious animals, reports of severe animal cruelty, dogs attacking livestock, and possible rabid animals, or possible human or animal exposure to wildlife when rabies is a concern.
  3. Investigations of animal cruelty.
  4. Removal of stray dogs from streets and public areas.
  5. Pick up stray animals from residences and businesses.
  6. Regulations and inspections of private and commercial kennels.
  7. Dog license enforcement.
  8. Rabies vaccination enforcement for dogs and cats.

Many victims of domestic violence have changed their lives and escaped the abuse. Talking with someone is the first and most crucial step in getting the help you deserve. There are people in your community willing and able to help you.

Personal Property and Real Estate

Tax rates are set each year by the Board of Supervisors during the month of April.

Personal Property Tax Due Dec 5th

All cities and counties in Virginia have a personal property tax. Amherst County taxes vehicles (cars, trucks, buses, motorcycles, motor homes), camping trailers, boat trailers, utility trailers, recreational vehicles, mobile homes, boats, and business furniture, equipment, inventory, machinery, and tools. Assessments are based on 100% of the NADA Car Guide clean trade value as of January 1st of each year. If the vehicle is not listed in the NADA Car Guide, the assessment is 90% of the cost. Code of VA Section 58.1-3518 requires every taxpayer owning any personal property subject to taxation (vehicles, boats, trailers, motorcycles, camping trailers) shall file a return by May 1 with the Commissioner of the Revenue.

Military VA Residents

All vehicles owned by a military individual who claims Virginia as their legal state of residence are subject to Personal Property tax.

Vehicles Sold, Junked or Moved Out of Amherst County

Notify the Commissioner of the Revenue and the Department of Motor Vehicles immediately when items are sold, junked, or moved out of Amherst County (providing the effective date); when your mailing address changes, or when you move.

PERSONAL PROPERTY TAX RELIEF ACT

What is the Personal Property Tax Relief?

The Personal Property Tax Relief Act of 1998 provides tax relief for passenger cars, motorcycles, and pickup or panel trucks having a registered gross weight of less than 7,501 pounds. To qualify, a vehicle must: 1) be owned by an individual or leased by an individual under a contract requiring the individual to pay personal property taxes; AND 2) be used less than 50% for business purposes. Motor homes, trailers, and farm-use vehicles do not qualify for tax relief.

Does your vehicle qualify for Car Tax Relief?

If you can answer YES to any of the following questions, your motor vehicle is considered by State Law to have a business use and does NOT qualify for Car Tax Relief. 1) Is more than 50% of the mileage for the year used as a business expense for Federal Income Tax purposes OR reimbursed by an employer?; 2) Is more than 50% of the depreciation associated with the vehicle deducted as a business expense for Federal Income Tax purposes?; 3) Is the cost of the vehicle expensed pursuant to Section 179 of the Internal Revenue Service Code?; 4) Is the vehicle leased by an individual and the leasing company pays the tax without reimbursement from the individual? **Please note** Starting January 1, 2012, high mileage will be taken into consideration if a 762 Personal Property form is filed before May 1. Provide a copy of the vehicle's last inspection receipt for proof of mileage.

Recreational Vehicles
 
All recreational personal property (camping trailers, pop-up campers, motor homes, boats, and boat trailers) must be filed annually with the Commissioner of the Revenue on or before May 1st. **Please note** Tax is based on the actual "situs" (physical location) of the property and not necessarily the actual residence of the owner. All property that is stored in Amherst County or normally located in Amherst County may be subject to personal property tax. Recreational vehicles must be registered with the Commissioner of the Revenue within 30 days of purchase or move to Amherst County. Business Personal Property Tax To Be Filed By May 1st and Tax Due Dec 5th

Business Personal Property Tax is assessed to each business on the property used in the trade or business (such as furniture, fixtures, equipment, inventory, machinery, and tools) owned on January 1st. Business Personal Property Tax Returns must be filed with the Commissioner of the Revenue on or before May 1st. Businesses must provide a list of properties indicating the description, date of purchase, and original cost for each item. If you do not receive a form, please contact the Commissioner of the Revenue.

 

Payments

Tax bills should be paid by check or money order payable to: Amherst County Treasurer. Timely payments can be made at the Treasurer's Office. In order to avoid long lines, residents are encouraged to mail their payments to: Amherst County Treasurer, P.O. Box 449, Amherst, VA 24521. **Please Note** Failure to receive a tax bill will not relieve the penalty and interest charge that will be applied to all past-due bills, as required by the Code of Virginia. A penalty of 10% is added to the assessed tax after the due date. An annual 10% interest is also added thereafter.

We currently mail out business personal property returns to all businesses currently on our tax rolls as of January 1 of each year.

Under Virginia law, real property is assessed to the registered owner on January 1st of the taxable year. For any sale thereafter, the seller and purchaser is required to resolve the taxes between themselves. The normal procedure, the taxes are pro-rated in the purchasers favor and credited to the purchaser at the time of the closing. The liability is prorated between the buyer and seller but the lien which arises from a delinquency attaches to the land.

If you buy property, your settlement attorney must ascertain all taxes due and prorates them for payment out of the proceeds from the sale. If you have sold the property referred to on the tax bill and another person has assumed responsibility for payment, please forward the bill promptly to that person or return it to the Treasurer's Office with information as to the new owner. A delay could cause the new owner to pay a penalty and interest for late payment.

Changes to  Real Estate Taxes  is as follows:

  • The Amherst County Board of Supervisors by County Ordinance No. 2021-0008, amended Section 14-26, of Article II, Real Property Tax, Chapter 14, Taxation, to the Code of the County of Amherst relating to the first installment of semi-annual taxes for real property.    The change is the DUE DATE for the first installment which shall be paid on or before July 1 of each year, beginning with 2022.  The second installment date remains the same – to be paid on or before December 5th of each year.    The Amherst County Board of Supervisors approved this change on September 21, 2021.
  • Truist, formerly SunTrust and/or BB&T, will no longer be accepting real estate and/or personal property tax payments, effective immediately. 

     

The Code of Virginia specifies in Section § 15.2-539.,'the executive head (County Administrator) must prepare and submit to the governing body a proposed annual budget presenting a financial plan for conducting the county's affairs for the ensuing year'.
 
The annual operating budget of a locality has to be approved by the governing body. In Amherst County, this is the Board of Supervisors.
 
The County operates on a fiscal year that runs from July 1 through June 30 of each year. The budget is normally adopted and approved in April, prior to the start of the fiscal year.
 
The development of the County's budget begins in January of each year. Work sessions for budget deliberations start in February.
 
A balanced proposed operating budget has to be advertised two weeks prior to a public hearing for citizen comments.
 
There is a waiting period after the public hearing before the Board of Supervisors may adopt the fiscal year operating budget.

Surplus Property is primarily disposed of by sale at Public Auction, which is advertised in local newspapers, public flyers, posting in public facilities, direct notification of previous buyers and/or posting on the Purchasing Department website. In 1991, Amherst County saw the need for a program to control the often damaging effects of land disturbance. To protect our streams and lands, the County adopted The Virginia Erosion & Sediment Control Regulations to govern land disturbance. A copy of the County ordinance can be found in the County Code, Chapter 11, Article IV.
On commercial projects that disturb more than 10,000 sq. ft., the County requires an engineered plan to be submitted and approved, along with a bond for erosion and sediment control measures, before a land disturbance permit will be issued. Please refer to the Amherst County Erosion and Sediment Control Checklist to ensure you have met all the requirements when submitting your plan.
 
We can use an "agreement in lieu" of a plan for issuing a land disturbance permit on residential projects. This does not relieve the owner/contractor from putting up measures to control erosion and sediment but allows you not to have an engineered plan unless there are continued problems with erosion or sediment leaving the site. The owner is still responsible for any damage to adjoining parcels or waterways, so control measures should be in place before any construction begins.
Whether you live in town or on a farm, there is something in 4-H for you. Youth ages 5-1 9 are offered an opportunity to learn leadership, citizenship, and many other life skills. There are 5,000,000 members in the U.S. and 140,000 in Virginia.

Amherst County has an enrollment of 1000 members and 30 leaders who take part in 5 community clubs and 23 school clubs. Members participate in State 4-H Congress, camp, livestock shows, presentations, public speaking, and many other activities.

Abuse and neglect of children is a serious problem in Virginia. Each year in this state over 48,000 children are reported for suspected abuse or neglect. The Code of Virginia requires local social services departments to respond to all valid reports and to assist families in protecting their children from harm.

 

The purpose of the child protective services program is to protect children; support and preserve families, when possible; arrange protective and other needed services; and prevent maltreatment.


Child Abuse & Neglect Definitions:

 

Section 63.1-248.2 of the Code of Virginia defines an abused or neglected child as any child under 18 whose parent, or other person responsible for the care of the child:
  • Causes or threatens to cause a non-accidental physical or mental injury; 
  • Neglects or refuses to provide adequate food, clothing, shelter, emotional, nurturing, or health care; 
  • Abandons the child; 
  • Fails to provide adequate supervision in relationship to the child's age and level of development; and 
  • Commits or allows to be committed any illegal sexual act upon a child, including incest, rape, fondling, indecent exposure, prostitution, or allows a child to be used in any sexual explicit visual material.
Infants who have been medically diagnosed for exposure to non-prescription drugs or  alcohol during pregnancy are also considered to be at risk of abuse or neglect. Attending  physicians are required to report these cases to CPS.
 
The Code of Virginia requires that mandated reporters immediately report suspected child abuse or neglect to the local department of social services or to the Child Abuse and Neglect Hotline.
 
You need not prove that abuse or neglect has taken place or determine the type of needed CPS response. Local departments of social services are responsible for making these determinations.

Amherst County Convenience Centers 

 

The Amherst County convenience centers are facilities where Amherst County residents can bring their waste for free.  The waste is collected at the centers and sites and then transported to the Amherst County Landfill for disposal.  Recycling services are also available for Amherst County residents at all convenience centers.  All Amherst County convenience centers are closed on the following holidays: New Year's Day, Independence Day, Thanksgiving Day and Christmas Day. All of Amherst County convenience centers close at 2:00 pm the Wednesday before Thanksgiving and on Christmas Eve.  See hours of operation for specific station information below.

Fire service in Amherst County is served by dedicated volunteers in three departments Amherst, Monelison and Pedlar with each having primary service areas in the county.  Three non-jurisdictional departments also provide first due response service in an effort to provide quicker response to these areas of the county. Public Safety personnel cross trained in EMS and Fire suppression also provide support to the volunteers as needed.  Each department is assigned a primary response area and also acts as backup response for other departments.

 

Volunteer fire service began in Amherst County in 1917 with Amherst Fire Department. It was after a large devastating fire swept through the Amherst livery stable, Meeks Building, and the Hill Hardware Lumberyard that the citizens decided a local department was needed. Amherst Fire was the only First Department between Charlottesville and Lynchburg. 

 

In 1959, the Monelison Volunteer Fire Department was founded by a group of individuals with one common goal: To protect the lives and property of the citizens of Amherst County.  At that time, there was one truck and one station.

 

In 1975, the men and women in the Pedlar area of Amherst County formed Pedlar Fire and Rescue to serve the citizens in the north western portion of the county.

 

During the years, Amherst County fire service has grown to a total of five fire stations, 8 engines, three tankers, four brush trucks, 2 squad trucks, 1 ladder truck, 2 Sport utility vehicles, 1 ATV and 100 volunteers.  It is a multi-million dollar business with a critical mission for our community and dedicated personnel.

 

We are forever grateful for all the men and women who worked so diligently to create, form, develop and establish the standards before us within each of these organizations.  Their commitment and dedication to their fellow citizens are the reason we are here today.  In addition to this group, are the many volunteers that have come and gone over the years that have maintained the traditions and brought these agencies to this point. 

The history of our existence is important and equally important is the future which is in our hands.  We must never lose focus about our purpose which is to provide fire and EMS services to Amherst County in a safe and professional manner.  It takes the contribution of the public, local government, the communication system and both volunteer and career personnel to make the system work.

 

The Amherst County Animal Care Center receives animals their owners must give up due to lifestyle circumstances. Animals are considered personal property in Virginia, and if jointly owned, both parties will have to sign the surrender document. Please have the co-owner send a note with you if both owners cannot come to the Care Center. Amherst County policy gives you the right to reclaim your surrendered animal within 24 business hours if you change your mind.
 
When you surrender an animal, we will ask you to help us complete a personality profile on your animal. This information will help others interested in adopting know about the animal's habits, likes, and dislikes and can explain any problems experienced with the animal. Personality profiles increase the likelihood that an animal will find a new family.
 
We cannot guarantee that the animal will be adopted, but we will try to find them a new home.
 

Note: § 18.2-144.2 A of the Code of Virginia states: "It shall be unlawful for any person to deliver or release any animal to a pound, animal shelter or humane society,...or to any similar facility for animals, or any agent thereof, and to falsely represent to such facility or agent that such a person is the owner of the animal."

The Commonwealth of Virginia requires Amherst County to require all dogs four months of age and older to be licensed annually. Dog licenses are sold in November each year and must be purchased by January 31. New county residents and new dog owners may buy permits throughout the year. All rights expire on December 31 each year, regardless of when they were purchased.
 
Amherst County dog license may be obtained for $5.00 for neutered males and spayed females and $7.00 for intact males and females upon presentation of a valid rabies certificate issued by a licensed veterinarian. All dogs and cats over (4) months old must have a current rabies vaccination. All dogs must have their license tags securely attached to a collar and worn whenever the dog is off its owner's property.
 
Kennel permits must have a Kennel Compliance Certificate issued by an Animal Control Officer. If you have a kennel and would like a kennel permit, please call 434-946-9300 and request an Officer to inspect your kennel.
 
Amherst County kennel permit license may be purchased after the certificate is issued for $25.00 for each group of (10) dogs.
 

You may purchase a dog license at the Animal Care Center or the Treasure's office in Amherst, Virginia.

 

Below are questions and answers commonly received regarding merchants and citizens who have received bad checks.
 
Question: I have received a check as payment, and the check has been returned as "Non-Sufficient Funds." I have heard this is a crime. What should I do to get a warrant?
 
Answer: Yes, it is a crime to pay for a service or product utilizing a check that a person knows cannot be cashed due to insufficient funds or on an account that has been closed. However, the Code of Virginia requires the recipient of the check to take specific actions before a person can be convicted of the offense.
  1. You need to mail a certified or registered letter to the person who wrote the check to you. Sending it to the address on the check or the last known address of the person who wrote it meets this requirement. The letter should tell the person they have ten days from receipt of the letter to make the check good before you attempt to bring charges against him/her.
  2. Make sure you make a copy of the letter.
  3. Ensure you keep the receipt of the registered or certified letter and bring it with you to court.
  4. Bring the check with you to court as well (along with the person who took the check and can identify the defendant)
 
Question: What happens if the person doesn't make payment before I go to the Magistrate and swear out a warrant, but later wants to make payment; am I permitted to accept the money even though the warrant has been issued?
 
Answer: Yes, you may accept the payment. However, the case will still come to court. It is requested that you not give the check back to the person as this is necessary evidence needed in a prosecution if the Commonwealth's Attorney deems it appropriate to prosecute the case. Make sure you issue the Defendant a receipt for the payment.
 
Question: I recently had a customer write me a bad check for $300.00. When I informed him his check had been returned for non-sufficient funds, he agreed to pay me in three monthly installments of $100.00 per month. He paid the first two months, but it has been five months, and he hasn't made the final payment. Am I permitted to take a warrant out for the $300.00 bad check?
 
Answer: In a word, No. Once you have accepted partial payment on a bad check, it becomes a civil matter and no longer qualifies as a criminal charge. You are certainly permitted to sue for the balance of the debt owed.

Businesses located in the County of Amherst are required to obtain a Business license. The license tax is based on gross receipts. Businesses must file a renewal application and pay the license fee by May 1 of each year. The business must be approved by the Zoning Office (434) 946-9303 prior to issuance of the license. If the business has a trade name, they must register their trade name with the Clerk of Circuit Court (434) 946-9321.

If gross receipts are under $50,000, you pay a $10.00 license tax. If the amount of gross receipts is over $50,000, see the rates listed below.

  • Contractors - $.13 per $100 of gross receipts
  • Services - $.31 per $100 of gross receipts
  • Professional - $.50 per $100 of gross receipts
  • Itinerant Merchants - $200.00 - 30 days or $500.00 annually.
  • Peddlers - $50.00 annually
  • Door to Door - $20.00 annually

 

Businesses that are obtaining a business license for the first time will estimate their gross receipts for the year. All businesses that have operated previously and are renewing their license may need to provide proof of gross receipts (Schedule C, or Corporate return) if audited by the Commissioner.

Personal Property tax accounts are established with the Office of the Commissioner of Revenue. The assessments are based on personal property owned on January 1st of the taxable year.

The Personal Property Tax Relief Act of 2005 provides that the tax on the first $20,000 of the value of a personal car, motorcycle, and pickup or panel truck under 7,501 pounds, which is a qualifying vehicle, has been reduced by 26.3% this year. Please contact your local Commissioner of Revenue or Treasurer with any questions.

The Comprehensive Plan is Amherst County's most important document regarding growth, development, and change. It establishes government policy to help guide public and private activities as they relate to land use and resource utilization. It is the basis for land development regulations and decisions (rezonings, special exceptions), capital improvements (public projects such as schools, parks, and libraries), transportation, environmental and historic resource protection initiatives, new county programs, and decisions on the distribution of county budget dollars to a multitude of programs and agencies.
 
State law governing the development of a Comprehensive Plan ( Virginia Code Section 15.2-2223) requires every county, city, and town to adopt a comprehensive plan for the physical development of its territory. It also requires that the Comprehensive Plan be reviewed every five years. Regardless of State Code requirements, it is important to periodically revisit and update the Plan to ensure that it is consistent with community views and is addressing current issues within the community.
In November 2015, the Amherst County Board of Supervisors adopted Part III of the Uniform Statewide Building Code, Property Maintenance.
The purpose of this code is to protect the health, safety, and welfare of the residents of the Commonwealth of Virginia, provided that the buildings and structures should be maintained at the least possible cost consistent with recognized standards of health, safety, energy conservation, water conservation, including provisions to prevent overcrowding, rodent or insect infestation, and garbage accumulation; and barrier-free provisions for the physically handicapped and aged.
This code sets a minimum safe standard for existing structures in Virginia.

Fire Marshal:

In addition to being the Director of Public Safety, this position also serves as the Fire Marshal for the county.  The Fire Marshal is responsible for enforcing the current Statewide Fire Prevention Code, which has been adopted by the County of Amherst.  Also, the following responsibilities fall under the Fire Marshal's office: issuing permits, performing safety inspections, reviewing plans for development, investigations of incidents involving fires, environmental crimes and bombings, as well as public education, public information and other related issues. 

Inspections

The goal of any State and County fire code is the prevention of fires and the loss of life. It is the responsibility of the Fire Marshal's Office to ensure public buildings and other places of assembly comply with these codes.   Our ongoing inspection priorities are those that do not change from year to year. These priorities include public and private schools, daycare facilities and licensed educational facilities.  We are also in the process of developing a program to inspect local restaurants.

Investigations:

The Fire Marshal is responsible for determining the origin and cause of fires in a effort to prevent future occurrences. The types of fires investigated include; large loss fires, fires of suspicious nature, fires involving personal injury, and explosions

If a fire can not be prevented, a clear cause must be determined. The ability to examine a fire scene and reconstruct the sequence of events that took place that caused a fire is part science and part skill. Skills are used to examine burn patterns and characteristics while science is used to analyze materials that burned or may have failed. When put together, a clear picture of how a fire started usually begins to take shape. It is the skilled fire investigator that can put these two together to know who, what, how, and when a fire started. 

Knowing how a fire started can provide valuable information that can lead to safer products and process that we use daily. Defective products can be recalled, and the public can be educated on how best to prevent similar fires in the future. 

Some fires may not be accidental in nature. Intentionally set fires (arson) account for tens of thousands of fires annually. In instances where an arson fire is suspected, Amherst County Fire Investigators team up with Amherst County Sheriff's Office Investigators or the Virginia State Police to solve the crime.

PUBLIC DISPLAY OF FIREWORKS

 

The following is the Amherst County Code for the use of fireworks:


Sec. 11.5-56.  Purpose of division.

The regulations contained in this division are hereby adopted to provide for the issuance of permits to fair associations, amusement parks and organizations and groups of individuals for the display of fireworks, and to regulate the use and display of fireworks upon the granting of such permits.

Sec. 11.5-57.  Filing and contents of application for permit.

(a)   Written application for a permit to display fireworks shall be made, in triplicate, to the director of public safety stating the time, place, type of fireworks and circumstances under which they are proposed to be displayed. Each such application shall name at least one (1) person who shall participate in displaying the fireworks and who has had experience in displaying the type of fireworks proposed to be displayed. Each application shall include a diagram of where the fireworks will be ignited and where spectators will be located. An on-site visit will be conducted by the department of public safety to insure all safety precautions as described in NFPA Code 11-23, "Display of Fireworks" are met.

(b)   No permit shall be issued until the applicant files with the director of public safety a certificate of insurance in the amount of at least one million dollars ($1,000,000.00) combined single limit for bodily injury and property damage. This insurance policy shall become available for the payment of any damage rising from the acts or omissions of the applicant, his agents or his employees in connection with the display of aerial fireworks. The applicant shall ensure that the insurance policy is in effect at the time of the commencement of the activities authorized by the permit, and remains continuously in effect until such activities are completed.

Sec. 11.5-58.  Approval of permit application.

Upon approval of an application for a permit to display fireworks, the director of public safety shall write across such application the word "approved", and the application shall be dated and signed by him.

Sec. 11.5-59.  Approved application constitutes permit; disposition of copies of application.

One (1) copy of each application for a permit to display fireworks shall be kept on file by the director of public safety until after the date the fireworks are displayed, and two (2) copies, after being approved as provided in section 11.5-58, which will then become a permit to display fireworks, shall be returned to the applicant, who shall keep one (1) copy on file for sixty (60) days after displaying such fireworks, and one (1) copy shall be in possession of the person in charge of displaying the fireworks at the time and place they are being displayed.

Sec. 11.5-60.  Term of permit.

A permit for the display of fireworks shall be valid only for a period of thirty (30) days from the date affixed to the permit application by the director of public safety pursuant to section 11.5-58, and all fireworks covered by such permit shall be displayed or discharged within such period.

Sec. 11.5-61.  Storage of fireworks prior to use.

Prior to the use of fireworks pursuant to a permit provided for in this division, they shall be stored in a metal container in a building of masonry, concrete or other firm construction, so that members of the public cannot have access to them, and such fireworks shall not be stored in the county for a period in excess of thirty (30) consecutive days from the date affixed to the permit application by the director of public safety pursuant to section 11.5-58.

Sec. 11.5-62.  Authorized participants.

The director of public safety and the applicant shall work together to determine the maximum number of persons who shall participate in displaying fireworks at one (1) time, and all such persons shall be over the age of twenty-one (21) years old.

Sec. 11.5-63.  Regulation of spectators.

No spectator or member of the public, other than those who are participating indisplaying or discharging fireworks pursuant to a permit provided for in this division, shall be allowed closer than two hundred (200) feet to the point at which the fireworks are to be discharged. In no case shall a display be fired within five hundred (500) feet of a school, theater, church, hospital, or similar institution.

Virginia State law requires proof of ownership to reclaim an animal from the Animal Care Center. A rabies vaccination certificate, an Amherst County dog license, veterinarian records, or a photograph of documentation will suffice. Owners / Reclaim persons must be 18 and bring personal identification. If another person reclaims an animal for the actual owner, the owner must send written permission with the individual so that we may release the animal to that person. Each time an animal is returned to its owner, we will verify proof of current rabies vaccination, and the animal owner must also present a current Amherst County dog license. If the animal rabies vaccination is expired or no proof can be given, the animal owner will make an appointment with a veterinarian before the animal is released.
 
Fees for reclaiming an animal may apply depending on how long the animal has been at the Animal Care Center and whether it was brought to the Center by an Animal Control Officer or county resident.
 
Housing is accrued at a daily rate of $10.00.
 

If an Animal Control Officer brings your animal to the Center, there will be an additional $10.00

All animal bites and any animals suspected of having rabies should be reported to the Amherst County Department or the Department of Animal Care and Control.
 
Animal Care and Control will respond to and investigate all animal bites and will ensure that any animals involved in these incidents are to be confined.
 

The Health Department is also responsible for confining domestic animals that bite people or expose them to rabies and for testing potentially rabid animals.

 
The Department of Animal Care and Control urges all cat and dog owners to have their pets properly vaccinated by state law. In addition, rabies clinics are held periodically throughout the year to allow citizens to have their pets vaccinated. Please get in touch with the Animal Care Center for these dates.

State Income Tax

The Commissioner of the Revenue office offers free state income tax preparation to Amherst County citizens, as well as the necessary forms to file.

In order for this office to assist you please provide a completed copy of your Federal tax return, and your W-2's.

The deadline for filing your State income tax return is May 1. You can mail your return to the Commissioner of the Revenue, P.O. Box 719, Amherst, Virginia 24521.

Food & Beverage Tax

Any business offering prepared food and beverages served with a meal (including alcoholic beverages) are required to levy a 6 percent tax.

The Commissioner will provide the necessary forms that are due on or before the 20th of each month.

Lodging Tax

Any motel, hotel or inn in Amherst County that provides lodging for compensation shall impose a 5 percent tax on the total amount paid for lodging.

In Amherst County, Virginia, any dog four months old or older must be vaccinated against rabies and be licensed with the county. This is required by the Amherst County Dog Ordinance and Virginia State Law. In accordance with Virginia Code Section 3.1-796-87.1, area veterinarians are required to notify localities when a rabies vaccination is given. The Treasurer shall send an application to the owner; then, the owner must sign and return the application and fee.

To purchase a dog license in Amherst County, Virginia you must present a valid rabies vaccination certificate to the Treasurer or Deputy Treasurer. The license can be mailed if the dog owner so desires. To obtain a Kennel License, inspection and approval of the kennel must be granted by the dog warden. He/she will issue a certificate to obtain the kennel license.

Dog Licenses are sold at the Treasurers Office at 100 Goodwin Street , Amherst, Virginia 24521 and Amherst County Service Authority Office, Phelps Rd., Madison Heights, Virginia 24572.
