Board of Appeals

Chapter 4, Article1, Section 4-32 of the Amherst County Code, in conjunction with Part I, Chapter I, Section 119, if the USBC (link) provides for a Board of Appeals so that the owner of a building or structure may appeal the decision of the Building Official refusing to grant a modification of the provision s of the Code concerning the manner of construction or materials to be used in the erection, alteration or repair of the building or structure. Application for an appeal may be made when it is claimed that the true intent of the Code has been incorrectly interpreted, the basic Codes do not fully apply, or an equally good or better form of construction can be used.

Appeals Process: The applicant shall submit a written request for an appeal to the local appeals board within 30 days of the decision by the Building Official. The application shall contain the name and address of the owner and, in addition, the name and address of the person appealing when the applicant is not the owner. A copy of the Building Official's decision shall be submitted along with the application for appeal and maintained as part of the record. Failure to submit an application for appeal within the time limit shall constitute acceptance of the Building Official's decision.

Appeals Board Meetings: The Appeals Board shall meet within 30 days after the date of a receipt of an application for appeal (unless agreed upon by all members). A notice indicating the time and place of the hearing shall be sent to the parties in writing to the addresses listed on the application at least 14 calendar days before the hearing. The Board shall meet at least once a year to elect a chairman.
